Terms of Use
Last updated October 4, 2026. These terms cover how you may use the We Dig Skulls website, our stories and our artwork, and they explain who you are dealing with when you buy a shirt, mug or sticker. In short, you may read and share links to our pages freely, you may not copy our artwork or articles without asking, and when you buy something, Fourthwall is the seller and its own terms govern the order.
Who we are and how these terms work
We Dig Skulls ("we") is a brand and Facebook page that has existed since September 2016, "For lovers of all things skulls and skeletons." This website publishes stories about skull and skeleton history and symbolism, and it links to a shop selling skull-art apparel, mugs and stickers.
By opening or using the site, you agree to these terms. If you do not agree, please do not use it. These terms govern your use of the articles, artwork and pages on this website. Buying merchandise is a separate matter, covered below under Fourthwall's terms. For how we handle personal information and storage in your browser, see our Privacy Policy and Cookie Policy.
Using the site
Use the site the way a reader would: read, share links, and write to us through the contact form. Please do not use the site for anything unlawful, to harass anyone, to scrape it or reach it with automated tools, or to interfere with how it works. If someone misuses the site, we may block their access.
Our content and artwork
We own, or hold the right to use, the original articles, illustrations, graphic artwork, photographs, logos and other materials on this site. In the United States, copyright protects original work by a human author as soon as it is fixed in a tangible form, and registration is not required for the protection to exist, as the U.S. Copyright Office explains. Our logo and name may have trademark protection that is separate from copyright.
You may read the site and view our artwork for personal, non-commercial use. Please do not copy, republish, redistribute, modify, sell or otherwise use our articles or artwork for commercial purposes without our permission. Laws that protect certain uses, such as quotation or fair use, still apply.
Want to reuse something? Ask first through the contact form, and tell us what you would like to use and where. The same form is the place to send a copyright concern about anything on the site. Material that belongs to Fourthwall, its suppliers or other third parties stays theirs, and we do not claim it. Fourthwall also runs its own copyright notice process for material hosted through its service, described in its Terms of Service.
AI-generated illustrations
Some artwork on this site may be made with the help of AI tools, and we label illustrations as illustrations. We do not present them as archival photographs or as evidence of a tradition.
Ownership of AI-assisted artwork is a more limited question than it is for a drawing made by hand. The U.S. Copyright Office said in its January 29, 2025 report that the outputs of generative AI can be protected by copyright only where a human author has determined sufficient expressive elements, and that using AI to assist in creating a work does not bar copyright. Its March 10, 2023 registration guidance adds that when AI determines the expressive elements, that material is not protected, while human selection, arrangement or creative changes may be. A prompt alone is not enough to make someone an author. The Office keeps further material on its AI page.
In practice, we claim rights in the human-authored parts of our illustrations and articles: the writing, the selection, the arrangement and the creative changes a human author makes. Protection may reach only those parts. The AI tools involved may also set their own rules on licensing and commercial use. Whatever the copyright status of a given image, please do not copy, reuse or sell the site's artwork without permission.
Links to other sites
Our pages sometimes link to other websites. Those sites are outside our control, and a link is not an endorsement or a sign of any partnership. Their content, policies and practices are their own, so read their terms before you rely on them.
Buying through Fourthwall
When you buy merchandise, Fourthwall is the merchant of record and the seller. We Dig Skulls does not print, pack or ship anything itself. Fourthwall takes your payment, makes each item to order, ships it, provides order support and handles sales tax.
Fourthwall's Terms of Service, last updated August 19, 2026, say that Fourthwall is the seller of its Products and that each product order is a transaction directly between Fourthwall and the buyer. The same terms make Fourthwall responsible for sourcing, shipping, returns and refunds, with stated exceptions. They also let Fourthwall refuse, cancel or refund orders where law, its policies, payment-network rules or fraud risk call for it.
On returns, Fourthwall's terms say it accepts returns within 30 days of the product order when a defect is covered by a supplier warranty. Apart from what the law requires, they say non-defective products generally cannot be returned or refunded. Fourthwall's terms also route most disputes to individual arbitration and choose their own governing law. That applies to your contract with Fourthwall, not to these website terms. Fourthwall's Acceptable Use Policy sets what store content may contain.
For questions about payment, delivery, damage, refunds or returns, use the order-support route Fourthwall shows in the store and at checkout, or its Help Center. The merchandise terms displayed at checkout are the ones that apply to your order. We will not post shipping times or return promises on this site that differ from Fourthwall's current buyer terms.
Disclaimers
We write our stories with care, but they are meant for general interest and are not professional, legal, medical or travel advice. The site and its content are provided "as is" and "as available," without promises that it will always be available, error-free or suited to a particular purpose. This does not remove any rights you have by law that cannot be waived.
Limitation of liability
To the fullest extent the law allows, We Dig Skulls is not liable for indirect or consequential losses that come from your use of the site or from relying on its content, or for the content and actions of other sites we link to. Nothing in these terms limits liability that cannot legally be limited. Liability for orders is addressed by Fourthwall's terms.
Changes to these terms
We may update these terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Using the site after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute about them will be heard in the state or federal courts located in Harris County, Texas.
